By accessing, browsing, or utilising the e-commerce functionalities of this platform, you agree to be bound by the following legally binding Terms and Conditions. Please read them carefully before placing an order.
1. Eligibility and Service Area
- By using this platform, you affirm that you are at least 18 years of age or possess legal parental guardianship to engage in commercial financial transactions.
- Our fresh fish delivery service is highly localised and strictly confined to designated operational pin codes within urban Patna, Bihar. Orders placed from unsupported locations will automatically be flagged and rejected by our system.
- We reserve the right to add or remove serviceable PIN codes at any time without prior notice.
2. Weight Variations and Product Characteristics
Fish is a natural, biological commodity. Therefore, it is impossible to guarantee absolute, exact weight measurements down to the single gram at the time of harvesting.
Pre-Cutting Weight:
All raw fish listed on our platform are priced based on their gross, pre-cutting weight.
Processing Loss:
When you select processing options (such as “Bengali Cut” or “Boneless/Fillet”), the fish undergoes cleaning, scaling, de-gilling, and evisceration. This cleaning process results in an inherent biological weight loss of approximately 10% to 15%. The package delivered to you will reflect this processed weight, but billing remains tied to the gross weight ordered.
Price Adjustment:
For Cash on Delivery (COD) orders, final billing may be slightly adjusted based on the actual physical weight of the harvested fish allocated to your order.
3. Pricing, Payments, and Billing
- All prices listed on pmbazaar.com are inclusive of statutory transactional charges where applicable. Fresh, unprocessed fish is classified under GST exempt/nil-rated schedules in India.
- We accept payments via verified online payment processors (Credit Cards, Debit Cards, Net banking, UPI) as well as Cash on Delivery (COD).
- For COD transactions, customers must settle the bill with our delivery executives via cash or a direct digital UPI QR code scan immediately upon package handover.
- In case of payment failure, the order will not be processed. Please contact your bank or payment gateway provider for failed transaction refunds.
4. Delivery Schedules and Customer Responsibilities
- We strive to fulfil fresh orders within our estimated 60- to-90-minute express windows or designated morning/evening time slots chosen by the customer. However, PM Bazaar cannot be held liable for unforeseen delays stemming from extreme traffic conditions, vehicular breakdown, or inclement weather patterns.
- It is the customer’s sole responsibility to ensure a representative is present at the designated delivery address during the chosen time slot. Because our products are highly perishable, undelivered packages due to customer unavailability will still be billed, and no refunds will be permitted.
- If you need to reschedule your delivery, please contact our support team at least 30 minutes before the scheduled slot.
5. Cancellation and Refund Policy (New Addition)
Cancellation by Customer:
- Orders can be cancelled within 10 minutes of placing them (before processing begins). A full refund will be issued.
- Once the order is processed or out for delivery, cancellations are not accepted due to the perishable nature of the product.
Cancellation by PM Bazaar:
- We reserve the right to cancel orders if the product is out of stock, the delivery location is not serviceable, or payment is not confirmed.
- In such cases, a full refund will be processed within 5-7 business days.
Refund Process:
- Refunds are processed via the original payment mode (online payments) or via bank transfer (for COD adjustments).
- Please allow 5-7 business days for the refund to reflect in your account.
6. Intellectual Property
All content hosted on this platform—including webpage layout designs, textual scripts, logos, AquaBridge infrastructure blueprints, and multimedia elements—is the exclusive intellectual property of Pushkar Maachhlo Bazaar Private Limited and is protected under Indian Copyright and Trademark laws.
Any unauthorised reproduction, distribution, or commercial use of our content is strictly prohibited and may result in legal action.
7. Limitation of Liability
To the maximum extent permitted by law, PM Bazaar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the platform.
- Any delay or failure in delivery due to circumstances beyond our control.
- Any unauthorised access to or use of our servers and/or personal data stored therein.
8. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of India. Any legal disputes or claims arising out of the use of this platform shall fall under the exclusive jurisdiction of the competent courts located in Patna, Bihar.
